Terms of Service

These Terms of Service ("Terms") govern your use of the Tonos voice profile service ("Service"), operated by Max Beato, doing business as Tonos ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.
1. The Service
Tonos is a voice profile API. You provide writing samples, we extract a structured voice profile, and you (or your integrated applications) use that profile to draft messages that match your writing style. The Service includes the web application, REST API, and MCP protocol endpoints.
2. Accounts
You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials, including passwords and API keys. You must notify us immediately if you suspect unauthorized access to your account. You must be at least 18 years old to use the Service. One person or entity may not maintain more than one free trial account.
3. Credits and Billing
The Service operates on a credit system. New accounts receive a one-time allotment of free trial credits. Paid plans provide a monthly credit allocation that resets each billing cycle. Credits do not roll over between billing periods.
Paid subscriptions are billed monthly through Stripe. You authorize us to charge your payment method on file for recurring subscription fees. You may cancel your subscription at any time; cancellation takes effect at the end of the current billing period. We do not offer refunds for partial billing periods.
We will provide at least 30 days' notice before any price increase takes effect on your subscription. If you do not agree to a price change, you may cancel before the new pricing applies. If you believe you have been incorrectly charged, contact us within 30 days for resolution.
4. Your Data
You retain ownership of all writing samples you provide. You grant us a limited, non-exclusive license to process your samples solely for the purpose of generating your voice profile. This license terminates when your samples are deleted.
Voice profiles generated by the Service are yours. We retain a limited license to store and use your voice profile data solely to provide the Service to you. We do not use your voice profiles to train models or for any purpose unrelated to delivering the Service.
Writing samples are processed to extract voice profiles and are deleted after extraction is complete. We do not store your raw writing samples beyond the extraction process. See our Privacy Policy for full details on data handling.
5. Acceptable Use
You agree not to use the Service to:
- Impersonate another person without their documented written consent
- Generate content that is illegal, harmful, threatening, abusive, or harassing
- Produce spam, phishing messages, or deceptive communications
- Violate any applicable law or regulation
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service's infrastructure
- Circumvent rate limits, credit restrictions, or access controls
- Resell access to the Service without our written permission
- Use the Service to build a competing product
We reserve the right to suspend or terminate accounts that violate these rules. Repeated or severe violations may result in immediate termination without notice.
6. API Usage
API and MCP access is subject to rate limits as described in your plan. API keys are confidential and must not be shared publicly or embedded in client-side code. You are responsible for all activity that occurs under your API keys. We may revoke API keys that are compromised or used in violation of these Terms.
7. AI-Generated Content
Messages drafted by the Service are generated by artificial intelligence models. While voice profiles improve the stylistic accuracy of generated content, you are solely responsible for reviewing all generated content before sending or publishing it. We do not guarantee that generated content will be accurate, appropriate, or free of errors. You assume all liability for how you use generated content.
8. Availability and Changes
We aim to keep the Service available at all times but do not guarantee uninterrupted access. We may modify, suspend, or discontinue any part of the Service at any time. We will provide at least 30 days' notice of material changes to features or pricing that affect paid subscribers.
9. Indemnification
You agree to indemnify, defend, and hold harmless Tonos and its owner, officers, and affiliates from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property or privacy rights; or (d) any content you generate, send, or publish using the Service.
10. Limitation of Liability
To the maximum extent permitted by law, the Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total aggregate liability for any claim related to the Service shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
11. Dispute Resolution
Any dispute arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If we cannot resolve the dispute within 30 days, either party may pursue binding arbitration administered under the rules of the American Arbitration Association. Arbitration shall take place in the State of Florida, and the arbitrator's decision shall be final and enforceable in any court of competent jurisdiction.
Class action waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If this waiver is found unenforceable, the entire dispute resolution section shall be void.
Small claims exception: Either party may bring an individual action in small claims court in lieu of arbitration.
12. Termination
You may delete your account at any time from your settings. We may suspend your account and provide notice if we believe you have violated these Terms. For non-material violations, we will provide 14 days to cure the violation before termination. For material or repeated violations, we may terminate immediately. Upon termination, your voice profiles and account data will be deleted within 30 days.
13. Force Majeure
We are not liable for any failure or delay in performing our obligations due to circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, failures of third-party services (including Anthropic, Stripe, or hosting providers), or other force majeure events.
14. Assignment
You may not assign or transfer your account or these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of assets, provided the assignee agrees to honor these Terms.
15. General
Governing law. These Terms are governed by and construed in accordance with the laws of the State of Florida, United States, without regard to conflict of law principles.
Severability. If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
Entire agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Tonos regarding the Service and supersede all prior agreements, understandings, or representations.
Waiver. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
16. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you via email or a prominent notice within the Service at least 14 days before the changes take effect. Continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service and delete your account.
